Federal Appeals Court Allows Education Department’s Plan to Lower Student Loan Payments

The temporary nature of the stay granted by the appeals court leaves many borrowers in the dark about their future financial obligations.

The Biden administration’s Student Aid Verification for Equity (SAVE) plan was created last year to provide relief to borrowers struggling with student loan debt. The plan offers lower payments and forgiveness for those who have made payments for at least 10 years and originally borrowed $12,000 or less. Education Secretary Miguel Cardona reaffirmed the administration’s commitment to fixing the broken student loan system and making college more affordable for Americans.

While the appeals court ruling is a step in the right direction, it does not impact the injunction issued by a federal judge in Missouri, which prevents the Education Department from forgiving loan balances going forward. This injunction is the result of lawsuits from Republican-led states seeking to invalidate the entire loan forgiveness program.
